Diddy Seeks Immediate Release from Prison in New Appeal

Diddy has taken steps to appeal his prison sentence, claiming it to be excessively harsh. The Bad Boy Records founder was sentenced to 50 months in prison last year after being convicted of two charges related to the Mann Act, specifically transportation to engage in prostitution, while being acquitted of more severe charges including sex trafficking and racketeering.

In a fresh appeal filed on March 13, Diddy's legal team describes the sentence as a “perversion of justice.” They are requesting either his immediate release with a judgment of acquittal or a remand for resentencing. The lawyers contend that Judge Arun Subramanian, who oversaw the trial, improperly engaged in “acquitted conduct” sentencing, which refers to imposing harsher sentences based on allegations that were rejected by the jury.

His legal representatives had previously argued for a much shorter sentence of 14 months, asserting that the current punishment is disproportionately long, being nearly four times the typical duration for Mann Act-related offenses. The appeal questions, “What is the point of a jury trial if your sentence is driven by what you were acquitted of doing?”

The U.S. Court of Appeals for the Second Circuit is set to review these arguments, with oral arguments scheduled for April 9. As it stands, Diddy is expected to be released from prison on April 25, 2028, according to the Federal Bureau of Prisons. Currently, he is housed at FCI Fort Dix, a low-security federal facility in New Jersey, which was deemed suitable by his lawyers for addressing his drug abuse issues and facilitating family visits.

Despite reports of him maintaining a positive demeanor in prison, including recent images showing him interacting with other inmates, Diddy has faced challenges. He was reportedly caught with homemade alcohol, known as “hooch,” made from Fanta, sugar, and apples.
